Independent Legal Advice
Before signing an agreement, it is always prudent to have a lawyer review it to ensure the document actually does what it is intended to do. When entering into family law agreements (separation or cohabitation agreements for example) or signing a personal guarantee with a bank, obtaining independent legal advice is a legal requirement; but in almost all cases – whether entering into a lease, an agreement for sale of land, or settling the terms of an employment severance package and release – obtaining an hour or two of qualified legal advice can save you thousands of dollars and years of regret.
Our firm’s goal in providing this advice is not to prevent a transaction or create a legal dispute between parties, it is simply to ensure you understand the obligations created by the document you are about sign, explain your legal rights and how they will be affected by the agreement, and to offer constructive solutions to any concerns you might encounter as you come to better appreciate the reality of what the agreement ultimately will and will not accomplish.
The amount of time a lawyer needs to provide appropriate independent legal advice varies depending on the size, scope and content of the agreement in question. Our lawyers will generally require the agreement to be provided to them in advance of your meeting (along with any other relevant information they require) so they can provide you with all of the advice you require during your discussion.
